Provided that legal authority to use proposed outdoor space exists, consent of neighboring property owners are waived. WHEREAS, Saint Paul businesses remain impacted by the Governors Executive Order 20-99 and reduced business related to COVID-19. WHEREAS, on May 25, 2020, George Floyd died while in the custody of officers of the Minneapolis Police Department; and, WHEREAS, following the death of George Floyd, civil unrest erupted in Minneapolis including fires, looting and other criminal behavior; and, WHEREAS, on May 28 -31, 2020, the civil unrest in Minneapolis spread to Saint Paul and included fires, looting and other criminal behavior causing significant damage; and, WHEREAS, along University Avenue between Snelling and Lexington avenues, more than 70 businesses were impacted , with more than a dozen sustaining serious fire damage; and, WHEREAS, civil unrest has arisen nation-wide since Mr. Floyds death; and, WHEREAS, on August 23, 2020, Jacob Blake, an African American man, was shot by police in Kenosha, Wisconsin, and since that date there has been civil unrest in Kenosha, Wisconsin including mass protest, fires, looting, and shootings; and, WHEREAS, on August 26, 2020, Eddie Frank Sole Jr., 38, died by his own hand while being pursued by Minneapolis police; and, WHEREAS, Eddie Frank Sole, Jr., was an African American man, and false rumors spread that Minneapolis police had shot Mr. 12.29; which the City Council consented to on March 17, 2020. While the COVID-19 testing positivity rate is trending down, the positivity rate in Ramsey County last week was 5% (up from a low in March of 2.3%), which remains an indicator that transmission is elevated and community mitigation measures are warranted to reduce transmission. Governor Walz, in Executive Order 20-56, has declared a peacetime emergency in the City of Saint Paul as well as the City of Minneapolis and the surrounding communities. On the afternoon of Sunday, April 11, 2021, a Brooklyn Center police officer fatally shot Daunte Wright, a 20 year old black man, during a traffic stop, inflaming already raw tensions between police and community members in the midst of the Derek Chauvin trial.
